TERMS & CONDITIONS OF USE
LDNZ Ltd is a graphic design and web development company
1. In ordering the services of LDNZ Ltd, you agree to be legally bound by these Terms and Conditions. Please read these terms carefully. If you do not accept these Terms and Conditions stated here, you may not use the LDNZ Ltd services in any way.
2. Fees for graphic design and web design services are charged on a 50% prepay basis.
3. Once the design questionnaire is submitted to LDNZ Ltd, work would start only when 50 % advanced prepay payment has been done.
4. Prepay Invoice issued must be paid within 3 days otherwise the order for graphic design work will not be entertained.
5. A reminder will be issued to clients when they overstep the logo package requirements. We would not give additional concepts without extra payment-$75/concept. Initially 2 concepts will be given. Based on feedback of first two concepts, third concept will be provided.
6. In case you don’t like the logo design, we would refund half of the prepay advance. The refund will be issued on submission of initial logo concepts only. Once revisions have been done no refund will be issued.
7 Where clients provide their own ideas and thoughts and are not open to our designers suggestions and recommendations, LDNZ Ltd will not be responsible for the end result of the design.
8. A legal notice will be issued to those who don’t make payment with 15 days of issue of final payment invoices. After 2 notices , the payment recovery will be passed on to a debt recovery company
9.Once the high resolution files for the approved design have been issued , redemand of these high res files due to accidental loss ,deletion or corruption will be charged extra.
10.There will be extra charges for high resolution files for logo icons, logo fonts or logo variations.
11. Client cannot own any copyright to any graphic design art work or web site design until all payments have been cleared.
12. Any reproduction , use or copying of our graphic designs without permission can result in immediate legal action.
13. Please check and proof read all the contact details in business card and stationery high resolution print files handed over by LDNZ Ltd before printing .We hold no responsibility for any mistakes in the contact details of business cards, letterhead ,envelopes ,complimentary slips or any stationery high res print files.
14. All brochure, flyer or presentation folder, label , packaging text content must be proof read and checked before submitting to the designer . Any change in the content after the print files have been created will be charged extra. So double check all text contents.
15. All Website Projects will be commenced only when 35% advance payment is received
16. Clients must approve the blue print of the website plan before website started. Without written approval of the website plan, the project wont be started.
17. Any change in the website plan once the website project has started will be charged extra
18. Though normally we don’t provide the client with hosting control panel login details as it is sensitive information. But if a client insists then we provide hosting control panel username and password details to manage the hosting and website maintenance on their own. If it used in insecure systems then website might be liable to virus attacks and errors, then LDNZ Ltd is not responsible for any suchvirus attacks or any hosting problems incurred.
19.Though LDNZ Ltd will try to resolve any hosting issues or scripting errors as soon as possible, we are not liable for any losses caused by these problems
20. Kindly plan the order of your graphic designs and website much ahead of the deadlines.
21. Though LDNZ Ltd tries to deliver all projects on time, yet delays may happen. We are in no way responsible whatsoever for losses incurred due to delays.
22. Any change in contents,design or functionality of the website once it becomes Live would be charged extra
23. LDNZ Ltd does not provide any refund unless under special circumstances only. The criteria of special circumstance is decided under the sole discretion of the Director of LDNZ Ltd only.
24. It is the client's responsibility to send complete extensive details for their graphic or web design project as per the order forms so that the designer or web developer has sufficient information before the project is started. LDNZ Ltd will not be held responsible for any errors in filling out the forms or any gaps in information.
25. LDNZ Ltd may not be held responsible in any way for the loss of profit of a company. LDNZ is not responsible for the project once it has been finalized and released.
26. Revision cycle consist of a number of times the artwork is sent to the client to review and the client’s subsequent response . Client agrees to provide timely responses to LDNZ Ltd after receiving status updates. It is the client's responsibility to maintain in contact with our design team during the design process. Client shall have a maximum of 60 days (including weekends) to respond to each set of samples sent to them for review. If after 60 days client fails to respond LDNZ Ltd consider the project complete and will close the project. At such time LDNZ Ltd shall have no further obligation to the client. If client responds after 60 days, a fee to have the project reopened will apply; this fee may also include higher design rate costs applying at that time.
27. Turnaround time is calculated from the day that LDNZ Ltd sends the order confirmation to client after having received creative brief, full payment and any additional information or images.
28. LDNZ Ltd gives initial design turnaround times for each package of logo design and web design; the full project time depends on the client's response to revisions.
29. LDNZ Ltd can in its own right begin and end special offers at any time.
30. LDNZ Ltd shall not be held responsible for artwork produced for a company that may not be registered and that there may be a legal issue due to the business name. LDNZ Ltd shall not be binded to the company legal problems in any manner. After project is finalized, additional fees apply for modifying artwork.
31. LDNZ Ltd packages include logo design and website design packages at a specific set price. Additional costs may apply if client requests services that are not included in the package
32. LDNZ Ltd cannot guarantee that a logo that we design will be absolutely unique . LDNZ Ltd guarantees that it will try to design a unique logo with original thoughts and artwork. If a logo is similar to another logo in the industry it would be purely coincidental and not a reflection of our design capabilities.
33.If a client contravenes the LDNZ Ltd terms and conditions, the service will be terminated immediately with no refund with immediate effect.
